Where a matter needs Court, we appear in the Federal Circuit and Family Court of Australia.
There is no automatic 50/50 split. The law looks at four things:
- the full asset pool, including superannuation and debts
- what each person contributed, financially and as a homemaker or parent
- what each person will need in future
- whether the overall result is fair
Married couples have 12 months from their divorce to start a claim. De facto couples have two years from separation.
We work out your asset pool and give you a realistic range for your outcome, then negotiate toward it. We make the agreement binding through Consent Orders or a Financial Agreement. If the other side won’t engage, we take the matter to Court. Our conveyancing team can also handle the transfer or sale of the family home in-house.

There’s no fixed 50/50 formula. The court (or an agreed settlement) looks at what each party brought to and contributed during the relationship, and what each person needs going forward, including earning capacity, health, age, and care of any children.

Yes, generally 12 months from a divorce being finalised for married couples, or 2 years from separation for de facto couples, though this can vary and it’s worth checking your specific situation rather than assuming.
Not as much as people expect. Property settlement looks at the whole pool of assets and contributions, regardless of whose name is on the title or bank account, so an asset in one person’s sole name isn’t automatically excluded.
