Parenting Matters in NSW Family Law
When parents separate, one of the most important steps is putting the right arrangements in place for the children. Parenting matters in NSW family law focus on ensuring every decision is made in the best interests of the child, with a strong emphasis on safety, stability, and wellbeing.
At Ryan & Ryan Lawyers, we help parents navigate parenting arrangements with clear advice and practical support, whether the matter can be resolved by agreement or needs Court intervention.
What Parenting Matters Cover
Parenting arrangements may include decisions about:
- Where the child lives
- How much time the child spends with each parent
- Communication, including phone and video calls
- Changeovers and special occasions (birthdays, holidays)
- Major long-term issues, such as education, health care, religion, and cultural matters
Resolving Parenting Disputes Without Court
In most cases, parents are encouraged to resolve parenting issues through negotiation or mediation, rather than going straight to Court. This approach can reduce conflict, keep costs down, and support healthier co-parenting moving forward. Once an agreement is reached, parenting arrangements can be formalised through:
- A Parenting Plan, or
- Consent Orders, which are legally binding and enforceable
When Parenting Orders Are Needed
If agreement cannot be reached, an application can be made to the Federal Circuit and Family Court of Australia for Parenting Orders. The Court’s priority is always the child’s best interests, including:
- Protecting the child from harm
- Supporting the child’s emotional and physical well-being
- Promoting meaningful relationships with both parents, where it is safe to do so
