Mediation & Alternative Dispute Resolution (ADR)
When relationships break down, resolving disputes early can make a significant difference to both your wellbeing and your future. Mediation and Alternative Dispute Resolution (ADR) are practical ways to resolve parenting and property matters without the stress, cost, and delay of Court proceedings.
At Ryan & Ryan Lawyers, we support clients through negotiation and mediation with a focus on respectful communication and practical outcomes.
What Is Mediation?
Mediation provides a structured and confidential environment where separated couples can discuss issues with the support of an independent and impartial mediator. The goal is to help both parties reach an agreement that is workable, fair, and focused on the future. Mediation can assist with:
- Parenting arrangements and communication
- Time spent with children and changeovers
- Property settlement and financial matters
- Reaching agreements without escalating conflict
Family Dispute Resolution (FDR) for Parenting Matters
In parenting matters, attending Family Dispute Resolution (FDR) is generally a legal requirement before starting Court proceedings. There are some exceptions where an exemption may apply, including situations involving:
- Family violence or safety concerns
- Urgency
- Risk to a child
- Other serious circumstances
We can advise you on whether FDR is required in your situation and guide you through the process.
ADR for Property Matters
For property settlement matters, mediation is not mandatory, but it is strongly encouraged. It often helps parties reach agreement sooner and avoid lengthy litigation. Benefits of Mediation and ADR Mediation are often:
- Faster than Court proceedings
- More cost-effective
- Less adversarial and stressful
- Better for maintaining communication, particularly where children are involved
ADR also supports cooperative problem-solving and can help parties reach mutually beneficial outcomes that focus on the best interests of the family.
When Court May Be Necessary
If an agreement cannot be reached, disputes may need to be resolved through the Federal Circuit and Family Court of Australia. Even then, mediation may still play a role throughout the Court process.
If you need advice about mediation, parenting disputes, or property settlement, we’re here to help.
